Lawyer: Do you need one for Divorce?

There are a number of reasons you may need child custody help. You could be seeking help for yourself or a loved one. It's probable though that you will need it for yourself so that the other parent doesn't get the custody you want. Most separations that are amicable won't result in a search for articles like this one. Still-there are children's lives at stake here and it is important that the custody battle does not adversely affect them any more than it has to. If you are looking for help with child custody cases, keep reading.

Be sure to have a decent attorney. You need an attorney who has quite a bit of experience in Family Court, when it comes to custody issues. A "run-of-the-mill" attorney isn't necessarily your best option in this case. You will have to find someone who practices family law and custody cases. These lawyers are far more familiar with the way Family Court works (which is a lot different than Criminal or Civil Court). You want a lawyer who knows how to work with kids and what judges look for when deciding what is in the best interest of your children. You will be much better off if you try to get someone who has a great knowledge of how to work with Child and Family Services as well because they will have had experiences working with the Department of Child and Family Services and making them feel mirthful if they get a call to help you with mediaton. Have you thought about joint custody? There are a number of ways to arrange for joint custody. Some joint custody arrangements work by splitting a child's time exactly 50/50 between his parents. Yet there are still others that are set up with the weight of the time in the hands of one parent. Your judge or mediator will probably ask that joint custody be the arrangement unless you can show cause otherwise such as immediate danger of physical harm. When you are asking for child custody help, you need to be prepared to at least explore the idea.

Remember your child loves the other parent and should not be used as pawns in the divorce. Keeping the children first is the priority for most parents in these situations, but it is always good to be reminded! Be sure to make time for them and give them the support they need. Your child is also having a hard time with this situation. When you require child custody help, you need to be certain that you are aware of your state laws. There are federal and state laws that command how custody wars should be settled. They discuss what you need to do if a parent moves to different state, if kids are taken across state borders and a bunch of other things that often arise. Some states even have acts that rule who will "automatically" be granted custody during a custody battle or when parents are in the middle of a separation period. The more you recollect about the laws within your state, the better you'll be at aiding your lawyer and the courts at recognizing why you are deserving of the custody arrangements you are requesting.

Once the child is placed with the most qualified parent or guardian, a pro will be children who are safe and happy. Your child could be pulled through the battle, and if it is an ugly one, it could have negative affects on your child. Meet with your lawyer before making your decision on whether to pursue child custody or not, they can discuss the pros and cons with you.

Prepare your heart for this possibility, even if your lawyer doesn't mention this scenario.
